Terms of Service

1. Acceptance of Terms

By accessing or using PromptAI ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

PromptAI provides an AI-powered prompt enhancement service that transforms user input into structured, effective prompts. The Service is available through our website and Chrome extension.

3. Account Registration

To use certain features of our Service, you must:

• Create an account with accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be at least 13 years of age

You are responsible for all activities that occur under your account.

4. Single Device Policy

Each PromptAI account may only be used on one device at a time. When you log in on a new device, your session on any previous device will be automatically terminated. Account sharing is not permitted.

5. Subscription and Payment

Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing, you agree to:

• Pay all applicable fees for your chosen plan
• Automatic renewal unless you cancel before the renewal date
• No refunds for partial subscription periods

We reserve the right to change pricing with 30 days' notice to existing subscribers.

6. Acceptable Use

You agree NOT to use the Service to:

• Generate harmful, illegal, or offensive content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Attempt to reverse engineer or exploit the Service
• Circumvent usage limits or access controls
• Share your account credentials with others
• Use automated systems to access the Service without permission

7. Prohibited Data and Regulated Information

You agree NOT to submit, paste, or otherwise transmit through the Service any of the following categories of information:

• Protected Health Information (PHI) as defined under the U.S. Health Insurance Portability and Accountability Act (HIPAA), including any individually identifiable health information about a patient, client, or other individual
• Payment card data subject to the Payment Card Industry Data Security Standard (PCI DSS), including credit card numbers, CVV codes, or magnetic stripe data
• Government-issued identifiers including Social Security Numbers, passport numbers, driver's license numbers, or national identification numbers
• Student education records subject to the Family Educational Rights and Privacy Act (FERPA)
• Non-public financial information subject to the Gramm-Leach-Bliley Act (GLBA)
• Attorney-client privileged communications or other materials subject to legal professional privilege
• Any other information regulated by applicable data protection or privacy laws that requires safeguards we have not specifically agreed in writing to provide

PromptAI is not a HIPAA Business Associate and does not currently sign Business Associate Agreements (BAAs). The Service is designed for general-purpose prompt enhancement — including marketing, content creation, productivity, and software development workflows — and is not intended for the processing of regulated personal data.

You are solely responsible for ensuring that any content you submit complies with this section and with all applicable laws. If you are subject to HIPAA, GDPR, FERPA, GLBA, or similar regulations in your professional capacity, you must redact, anonymize, or otherwise remove regulated information from prompts before submission.

We reserve the right to suspend or terminate accounts that violate this section, with or without notice. To the maximum extent permitted by law, we disclaim all liability for any consequences arising from your submission of prohibited data in violation of these terms.

8. Intellectual Property

Our Content: The Service, including its design, features, and content, is owned by PromptAI and protected by intellectual property laws.

Your Content: You retain ownership of the text you submit. By using the Service, you grant us a limited license to process your content for the purpose of providing the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. THE QUALITY OF ENHANCED PROMPTS MAY VARY AND IS NOT GUARANTEED TO PRODUCE SPECIFIC RESULTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROMPTAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS.

11. Termination

We may terminate or suspend your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Extended periods of inactivity

You may cancel your account at any time through your dashboard or by contacting support.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
